Hi All,
One of my friend has been working for a desi company for 6 months and now is moving to another company.
In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
There is no statement regarding leave encashment policy in the offer letter
So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. Hi Folks
just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited

Hello,
I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

Hi,
The I-485 case of mine, my wife and son was approved on Aug 5 2010. My case is EB2 and priority date is Jan 2006. When I enquired USCIS 2 weeks back on not receiving the physical cards for us yet, we got a reply mail for all of us that USCIS is waiting for our biometrics. Why is a biometrics needed after I-485 is approved? Me and my wife gave our biometrics last September only.
We are not sure when we will receive our biometrics notice and how long will it take to get our physical cards after that? Please guide me on this.

I have filed the H1B(I129) transfer and extension on H4(I539) in the month of June 18th and then upgraded to premimum process in the month of November, after 2 days it got approved and within the next two days they changed the status to RFE and requested to send the paystubs for the past 3 months. I have all the paystubs and our attorney sent the response with the paystubs to USCIS. In between this my wife travelled to India when my I129 and I539 pending.
1) Do you think there will be any problem for my visa to be approved(since my wife is in India)?
2) Can my wife visa gets approved when she was in India?
3) How long do they take to respond to the RFE?
Please advice.

Is core working to get similar bills for HR.5882 and HR 5921 to get introduced in Senate?

Hello!
I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.
