Sir/Mam,
I am was in US on H4. I am currently in my home country for vacation.
While here, I got my H1B applied and approved as consular processing for 2011 cap.
I plan to go back to US in August on H4 and then apply COS in October and start working.
My question is : Since my H1 was approved while I was out of US, will my COS also be approved as consular processing only? Do I have to go for stamping again before I could start working???
Also, if I decide to wait and get my H1 stamped in my home country, what is the earliest I can go to stamping for 2011 cap? Can I land in US on H1B sometime mid September and start working from October.

Her H4 is not dependent upon the employer but on her spouse maintaining a valid H1 with an employer. There is no need for your wife's friend to worry or do anything.
However, if she wants to get a visa stamp, she would have to go with her husband's current H1 I797 at that time.

hi all,
I've found myself in abit of a predicament. My application for H1B extension is still pending (filed in September) and all I have right now is a Notice of Action from the immigration department.
While waiting, I have been laid off this week... I intend to return back to my home country before my last day (Dec 31).
My question is: Would I be able to make a round trip? That is to say, come back to the US on a tourist visa a week after I got home? I need to come back to sell what I own here and settle other things.
A friend told me that it is better to overstay for however long (maybe an extra week, I don't plan on too long) I need to get my things in order than try to take the chance of coming back. What do you think?
I appreciate any advice you can give.

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.
Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.
Please suggest me the best possible way ...

Hi all,
I got my labour approved in Jun'07 and applied for my I-140 in Aug'07 and have been waiting for it to be approved since then. I have not yet applied for I-485. Also,I am almost reaching my 6th year of H1-B visa(FYI:I have not got my visa stamped yet).
Now my questions are,
1) Will I be able to switch my employer now that I am in my 6th yr of H1-B.
2) If it's OK to switch, how many months are supposed to be left on H1-B visa to transfer to another employer.
3) What will happen if my present employer revokes my GC application.
4) When is the best time to switch as I will get 3 yrs of extension once I-140 is approved.
5) Will I be able to retain my priority date if my employer revokes my GC application.
Please do respond. I look forward to your replies.

Is there any body who have I485 filed at TSC and EAD and AP filed at NSC. If it is so, will that create problem in getting that EAD card? Since, they check 485 filing for EAD card production. Please advice.

I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

I have a question. My wife called TSC today, and she talked to one of the most rudest person in the world. unfortunatelly she forgot to write his information down.
Baiscally, while she was talking my son was bothering her and cryin in a low pitch. The bastard TSC agen had the odesity to tell my wife to take the kid away, and htat is he dying.. you should got help him. Obviouslly he was not saying that because he was nice. He started to laguh. I am so furious right now.
So my question is can we find out who this agent was by callin INS and asking them who opened her file last. I sure would love to have few minutes with him one on one. Show him what we do to peace of crap like him if we was back home.
Anyhows, appreciate your answers.
